ASSUMPTION OF RISK, RELEASE, COVENANT NOT TO SUE, AND INDEMNIFICATION AGREEMENT

I, the undersigned, desire to work as a volunteer for Valentine’s Day Widow Outreach Co. (the “Widows Outreach Project”) during its 2024 Valentine’s Day Event (the “Event”) in February 2024.  I understand that all or part of my work as a volunteer for the Event will take place at the William R. Davie Conference Center located at 4635 Pineville-Matthews Road, Charlotte, North Carolina (the “Property”), as well as other locations in and around Charlotte, North Carolina.  

In consideration for the ability to participate in the Event, I, the undersigned, do hereby freely, voluntarily, and without duress, execute this Agreement under the following terms:

1. WAIVER AND RELEASE.  I do hereby waiver, release, and forever discharge and hold harmless the Widows Outreach Project and its Board of Directors, sponsors, employees, agents, and other volunteers (collectively, the “Released Parties”) from any and all liability, claims, and demands of whatever kind or nature, either in law or in equity, which arise or may hereafter arise from my work with the Widows Outreach Project. 

I understand that this Release discharges the Released Parties from any liability or claim that I may have against the Released Parties with respect to any bodily injury, personal injury, illness, death, or property damage that may result from my work with the Widows Outreach Project, whether caused by the negligence of the Released Parties or otherwise.  I also understand that the Released Parties do not assume any responsibility for or obligation to provide financial assistance or other assistance, including but not limited to medical, health, or disability insurance in the event of any injury, illness, death, or property damage.  

1. ASSUMPTION OF RISK.  I understand that my participation in the Event may include activities that may be hazardous to me, including, but not limited to the use of dangerous tools and equipment, the loading and unloading of supplies, materials, and equipment, and transportation to and from the Property before, during, and after the Event.  I hereby expressly and specifically assume the risk of injury or harm in these activities and release the Widows Outreach Project from all liability for any injury, illness, death, or property damage resulting from the activities associated with volunteering at the Event. 

2. INDEMNIFICATION.  To the fullest extent allowed by law, I agree to defend, indemnify, and hold harmless the Released Parties from any and all claims, causes of action, lawsuit, injury, death, or loss or damage to person or property brought by or on behalf of myself, any other volunteer or participant in the Event, or any other person arising from or relating to my participation in the Event, including but not limited to any claims that the Released Parties were negligent.  

3. COVENANT NOT TO SUE.  It is my express intent that this Agreement shall bind the members of my family and spouse, if I am alive, and my heirs, assigns, and personal representatives, if I am deceased, and shall be deemed as a release, waiver, discharge, and covenant not to sue the Released Parties.

4. PHOTOGRAPHIC RELEASE.  I hereby consent that my photograph may be taken or my image may be digitally recorded while I engage in work for the Widow’s Outreach Project and do hereby grant and convey to the Widows Outreach Project all right, title, and interest in any and all images, video, and audio recordings made by the Widows Outreach Project during my work for the Widows Outreach Project, including but not limited to any benefits derived from such photographs or recordings on social media or otherwise.

5. APPLICABLE LAW.  This Agreement shall be governed by an interpreted in accordance with the laws of the State of North Carolina.  I agree that this Agreement is intended to be a broad and inclusive as permitted by the laws of the State of North Carolina.  In the event any clause or provisions in this Agreement is held to be invalid by any court of competent jurisdiction, the invalidity of such clause or provision shall not otherwise affect the remaining provisions of this Agreement which shall remain in full force and effect and enforceable.  

I ACKNOWLEDGE THAT I HAVE READ THIS DOCUMENT, AND I FULLY UNDERSTAND ITS CONTENT.  I AM AWARE THAT THIS IS A RELEASE OF LIABILITY AND A CONTRACT AND I SIGN IT OF MY OWN FREE WILL.
